Sean M. Byrne, Esq. Completes Term as Chair of the Sarasota County Bar Association’s Estate Planning and Probate Section

Attorney Sean Byrne has completed his term serving as chair of the Estate Planning and Probate Section of the Sarasota County Bar. The Sarasota County Bar is divided into 11 sections based on area of practice, and the Estate Planning and Probate Section is open to all Sarasota lawyers interested in trust law, estate planning, and probate law. At the section’s bi-monthly lunch meetings, attorneys have the opportunity to learn from and with each other as they progress in their field.

Sean continues to serve on the Estate Planning and Probate Section’s executive committee as the immediate past chair.

Attorney Sean Byrne was on the front page of the June edition of the Sarasota County Bar Association’s monthly publication The Docket, a resource of information, entertainment, and dialogue for the lawyers of Sarasota, Osprey, Nokomis, Venice, North Port, and Englewood.

Sean’s article, titled “Underutilized Tools for Non-Adversarial Proceedings,” elaborates on Florida Probate Rule 5.080, which provides a path for all guardianship and probate attorneys to “… take depositions, issue interrogatories, request documents and admissions, and even seek sanctions against a party (or third party) that does not comply with the discovery requests.” In fact, Sean writes, any interested person can make use of this tool in order to conduct discovery in the probate process. Tallahassee Judge Rules Florida Misused Conservation Funds

In 2014, the Florida Water and Land Conservation Initiative (Amendment 1) was passed overwhelmingly with 74.96% of the vote. Upon passage by the voters, the Florida Constitution now regulates that 33% of net revenue from the existing excise tax on documents to be dedicated to the Land Acquisition Trust Fund. This Trust Fund was developed to acquire and improve conservation easements, wildlife management areas, wetlands, forests, and more.

However, a Tallahassee circuit judge has recently ruled that the state of Florida has not been properly appropriating the funds to the Trust, issuing a summary judgment in favor of the Trust. This summary judgment gives the Trust a victory in the case without needing to go to trial.

The process of selection is multi-faceted, with each nominee being evaluated based on 12 factors of peer recognition and professional achievement. These indicators include representative clients, honors/awards, pro bono/community service, scholarly writings, and more. Babette B. Bach, Esq. Receives the Lifetime Achievement Award

Babette B. Bach, Esq. received the Lifetime Achievement Award from the Florida Bar Elder Law Section during the Florida Bar’s annual convention in Orlando on June 15.  Babette was presented with the award by current chair Collette Small and past chair Emma Hemness, who gave a personal introduction.  In her acceptance speech, Babette spoke about the importance of having a progressive management style that inspires loyalty from staff and clients.  Babette’s family and law firm staff were in attendance for the award ceremony in Orlando. Babette is a Florida Bar Board Certified Elder Lawyer and a Certified Elder Law Expert by the National Elder Law Foundation.  Babette was the Chair of the Florida Bar Elder Law Section from 2009 to 2010 and the Chair of the Sarasota County Bar Association’s Estate Planning and Probate Section from 2016-2017.  She is the founder of Bach, Jacobs, & Byrne, P.A. in Sarasota.

Older Americans Month

In 1963, John F. Kennedy declared May to be Senior Citizens Month and in 1980, President Jimmy Carter decided to change Senior Citizens Month to Older Americans Month. This month, we celebrate the lives of our older Americans and reflect upon their many contributions to our nation.
